✦ GENERAL
• You acknowledge that you ordered a digital illustration for a commission and thus, there is no shipping of a printed illustration as well as any other physical goods.
• The background of the commission will be off-white, unless a solid color of your choice is requested.
• Please maintain the number of references among 1 and 5 images only.
• Please provide a full and good quality image reference. Image references must be clear enough to check all the design details.
• It is OK to send art done by other artists if a reference sheet is not available. References that are in writing only will not be accepted.
• I will not be responsible for any design malfunctions on the final version of any commission due to incorrect or missing information.
• Please contact me for any concern or question you might have.
✦ COMMUNICATION
• It is the commissioner's (you) responsibility to provide all relevant information when requesting a commission.
• I retain the duty of informing you about any delay or problem that might interfere on the production of your commission.
• You shall give full confirmation of the sketch for me to continue to finish the piece as soon as possible. • The commission will not be developed any further until confirmation.
• If you fail to confirm the sketch within the window of 2 to 4 months of no-replying, your commission will be dropped.
• Please refrain from requesting more than 1 commission at once. If you want two commissions, you shall wait until the first is finished so you can request the other.
• You understand that I retain the rights to decline commissions without further explanation.
• Please, be patient.
• For commercial use, please e-mail me for a quote.
✦ PAYMENTS
• Price might increase due to the amount of detail of the character requested or the background requested. Any inquiries about how detailed is too detailed, message me.
• All invoices are due within 7 days from receiving them, unless agreed otherwise.
• Invoices past the due date will be cancelled, also cancelling any associated commissions.
• I will start sketching after confirming the payment received in advance.
• The upfront payment needs to be at least 50% of the total amount of the commission for me to start working on it.
• I reserve the right to not work on your commission before receiving at least 50% of the payment.
✦ REFUNDS
• Full refunds are issued only before you have been sent and have approved the sketch.
• Under no circumstance refunds will be issued after the commission is properly agreed upon, and all sketches are approved.
• If you request a commission and I cannot draw your commission under the window of 6 months, for any given reasons on my part (that in which will be stated, and explained, and given account for), I'll refund you back 10% to 60% of the value, depending on how developed the commission is at the point of withdrawal. ONLY and only in this case. Covering taxes do not apply.
✦ REVISIONS
• You will receive an initial sketch based on the references and ideas discussed. Major edits can only be made during this phase.
• You will receive two revisions of the initial sketch for free. All edits shall be completely agreed by both parties.
• Any further revisions of the initial sketches will receive an additional fee accordingly.
• If there is any element of the commission that you do not like after the commission is finished, it will only be corrected upon an extra fee.
• You are not to rush or spam about progress pictures. Progress on the commission will be sent only during sketch and lining phase.
✦ DEADLINES AND DELIVERY
• Your commission will be finished under the window of 3 to 12 weeks.
• If the commission isn't finished after the established time, you will be notified and given account for on the status of progress and time left for delivery, and thus, if necessary, more time can be requested to complete the illustration.
• If there is a deadline, you understand that you have to communicate in advance, and thus, pay an additional fee accordingly (if the deadline is too close from the request date).
• You acknowledge that the commission queue order and the to-do list are not the same list and thus, some works might be finished before yours do.
✦ INTELLECTUAL PROPERTY RIGHTS
• UNDER ANY CIRCUMSTANCE you must claim my work as yours, as well as use the commissioned image(s) for commercial or profit purposes, including prints, reselling and/or redistribution of the commissioned image(s) unless otherwise specified. Breaking this term means you are subject of legal action against copyright infringement.
• I do not claim any rights or ownership towards any characters and other intellectual properties used and reproduced in the finished illustration.
• I do not claim any rights or ownership towards any other intellectual properties that can be used as resources in the process of creation of the finished illustration.
• I reserve full rights to the finished image(s) and images of progression (WIPs) and their distribution and use, unless otherwise specified.
• I do not allow my art to be minted and/or sold as Non-Fungible Tokens (NFT).
• I do not allow my art to be used to train any Generative Image Artificial Intelligence (GenAI) service.
• I do not allow my art to be reproduced in any place (physical or digital) unless otherwise specified.
✦ USE
• There are three different uses for the commissioned art you might get: Personal use, Commercial use for digital media, and Commercial use for physical media and merchandise:
Personal Use: Personal use implies that the artwork will not generate any sort of revenue to the client, either directly or indirectly. This usage categorizes in the likes of profile pictures, gifts for friends and family, personal social media posts, original character art collection, role-playing game portraits & world building, and many other personal art collection purposes. They are not suitable for any commercial or promotional applications, and usage for content creation (such as YouTube, Twitch or the like) that creates revenue is forbidden.
Commercial Use (Digital): Commercial use implies that the artwork will be used to generate revenue for the client, which may be accounted for as financial gain or other marketing gain purposes. The digital usage categorizes in the likes of content for Vtubers and streamers, digital exclusive album covers, promotional art, commercial videos, content for subscription services (such as Patreon, Ko Fi, Only Fans, etc.) or content creation services (such as You Tube, Twitch, Instagram, Tik Tok, etc.), as well as videos, comics, novels, game sprites, CGs, assets, concepts, loading screen covers, social media posts, banners, and more.
Commercial Use (Merchandise): This usage categorizes as artwork destined to become physical merchandise, such as posters, keychains, buttons/enamel pins, mugs, Dakimakura pillows, phone cases, journals, wearables (t-shirts, hoodies, sweaters, caps, hats, etc.), pads, personalized gear, prints, book covers, book illustrations, CD/Vinyl album covers, and more.
• It is forbidden to use the commissioned artwork for any purpose other than that specified at the time of ordering.
• For other additional uses, such as commercial use, be sure to request the additional licenses at the time of ordering.
• You may use the artwork for the intended purposes you chose at the time of your request and other personal uses. This includes but not limits to: wallpapers, cropping the image for avatars/icons, printing the image for personal display, etc., posting on personal social media as long as credit is given in a visible manner.
• The use of the following is NOT ALLOWED unless Commercial Use license is bought: promotional material, game assets, prints, postcard, merchandising of any kind, banners for commercial profiles on social media, and other uses that may be accounted for as financial gain or marketing revenue.
• Any individual using my art for self-promotion and/or profit will be subject to legal action.
• I reserve the right to repost commissions on my social media and/or use them in my commission samples and portfolio.
• You shall not remove my signature/watermark or alter my finished work in any way, such as changing colors, adding elements and/or editing my work.
